STC helps West Interactive fend off Phoenix

West Interactive Corporation (West) dealt a severe blow on August 25, 2010, to Phoenix Solutions’ litigation campaign based on its extensive speech technology patent portfolio when United States District Judge Mariana Pfaelzer of the Central District of California granted West’s motion for summary judgment, finding non-infringement of US Patent 6,633,846; and better yet, invalidity of claims 1, 8, 9, 12 and 13 of US Patent 7,277,854; claims 30 and 35 of US Patent 6,665,640; and claims 1, 2, 6, 7, 9, 10, 14 and 15 of US Patent 7,555,431. The invalidity finding was based on prior public use of the claimed subject matter.

West argued that the invalidated claims were anticipated by the public use of both the Galaxy system and the SpeechMania system. While the court ultimately based its holding of invalidity on the Galaxy system, the Speech Technology Consortium helped West in identifying relevant prior art and collaborating with Industry experts.

Update: The case is presently on appeal before the Court of Appeals for the Federal Circuit (Case No. 2011-1022).
